Process for online orders and cancellations

Ordering process and contract formation

Please see How to Order for instructions about how to place an order.

By completing and submitting an electronic order, you are making an offer to purchase goods, which, if accepted by us, will result in a binding contract.

The description of the goods, services, price, currency, if appropriate VAT and delivery costs are set out on the order page.  The advertising of products and services on this site is an 'invitation to treat'. That means your order is an offer and no contract of sale is formed between you and Ammika Jewellery until you receive the 'confirmation of order' email. Orders shall be accepted at our sole discretion but are normally accepted once credit card authorisation has been confirmed, the order reflects current pricing, stock levels have been checked or in the case of services we can offer the service you require.  Once we accept your order, you shall pay the price for the goods or services and delivery and other costs specified on the order page and we shall charge your account for payment.  Please keep your "confirmation of order" e-mail for your records. In exceptional circumstances, if we are not able to fulfill an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email. In no circumstances will we be liable to you for any additional amounts. These terms and conditions cannot be varied except by changes made by Ammika Jewellery on the site, which we may make from time to time. Proposed changes to the terms and conditions will be notified to you by e-mail or flagged for your attention when you log onto the site for a new session.  Your continued use of the site after such notification shall be taken as your full acceptance of such changes.  You will only own the goods you purchase once they have been successfully delivered and when we have received cleared payment for them in full.  Until that time we will retain title to the goods.  Goods supplied are not for resale.

Please note orders will only be despatched once we have authorisation from your payment card issuer. We will aim to inform you as soon as possible if there is an issue with the payment authorisation process or with any validation checks for your order. We will not accept your order if payment is not authorised. Where there are issues with the authorisation process or validation checks, your delivery may be delayed as a result.

We do not have to accept your order, and in particular, we will not accept your order if:

  • We do not have the goods in stock/the goods in stock appear to be damaged;
  • Your payment is not authorised;
  • There is an error on our Website regarding the price or other details of the goods;
  • You have cancelled your order in accordance with the instructions below

We will be in contact with you as soon as practicable by email  in each of the above circumstances to discuss your options. We reserve the right to refuse any order.

Cancelling an order before despatch

If you change your mind after placing an order, you can cancel it at any time before we have sent our Despatch Email to you. Please email us at enquiries@ammika.co.uk to cancel your order, you will need to give us your name and address details, as well as your order number.

If you cancel part of an order the postage and packaging charge is recalculated on the price of the goods you keep. This may affect your delivery charge payment. For example, if your order is for £60 worth of goods and you then cancel a £16 item, your order total will drop below £50, and you will no longer qualify for FREE Standard delivery.

Returning goods after despatch

A separate charge of £10 is made for each separate order.

The cost of returning and packing any goods to us after they have been received by you is your sole responsibility

Faulty goods

We will not be responsible to you or any third party for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any indirect or consequential loss in connection with your use of the Website.

  • defective products under the Consumer Protection Act 1987; or
  • any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

Quality

We warrant that (subject to the other provisions of these terms and conditions) on delivery the Goods shall be of satisfactory quality within the meaning of the Sale of Goods Act 1979. We shall not be liable for a breach of the warranty unless: the Goods are returned to us at your expense within 7 days of the date of delivery and provided you have notified us at the time of delivery (we recommend that you use recorded delivery and keep your proof of postage); and we determine in our reasonable discretion that the Goods are defective as a result of faulty materials or workmanship.

We shall not be liable for a breach of the warranty if: the defect arises because you failed to follow our verbal or written instructions as to the storage, use or maintenance of the Goods or (if there are none) good trade practice; or you alter or repair such Goods without our written consent. The items we sell are delicate and contain many crystals therefore care should be taken when using these items to avoid loss and damage to the crystals and goods.

We shall not be liable to you for any alleged loss, theft or damage of the Goods in transit unless this is notified to the carriers and ourselves immediately following delivery and, where it is alleged that the Goods are damaged, the Goods are returned to us in accordance within 7 days of date of delivery. In particular, but without limitation, we shall have no obligation to replace the Goods. For hygienic reasons, we do not accept returns on earrings.

Our jewellery and goods is imitation unless otherwise stated. Due to the nature of such jewellery, goods and its low cost, it will go off colour over time, especially metal-based goods. We shall not be liable to you for any jewellery or goods that have discoloured.

In addition many items are hand made and contain many small crystals which may become dislodged if they are accidently knocked therefore care needs to be taken using these items as accessories. We shall not be liable for any loss and damage of crystal stones. In some instances we provide spare stones at the time of purchase specifically for this reason like the crystal clutch bags.
